Last updated: October 31, 2026. Here is what data we use when you visit Motarea, shop or contact us, why we need it and how you can exercise your rights.
1. Who is responsible for your data
The controller is MOTAREA MOTOR, SOCIEDAD LIMITADA LABORAL, tax ID B05655972. Registration details: sheet TE-00008000, electronic folio, IRUS 100048049336 and EUID ES44009.000116526.
For any privacy question, email info@motarea.com.
2. What data we may process
- About you and your purchase: name, contact, billing and delivery details, account, basket, orders, payments, returns and guarantees.
- About your motorcycle and preferences: saved vehicles, compatibility enquiries and the options you choose.
- When you contact us: messages, documents or photos you send and information needed to help you. Customer service calls may be recorded, with prior notice, to monitor quality and improve service. We may transcribe and summarise them using automated tools for internal use with human review.
- About your use of the website: IP address, device, security logs, identifiers, cookies and consent choices, plus browsing or campaign data where applicable according to those choices.
Motarea receives limited payment information, such as status, amount, reference and a summary of the method. Full card details and the security code are processed on Stripe’s or the payment provider’s page; we do not receive or store them.
3. Why we use it and our legal basis
- Helping you and handling your purchase: enquiries, accounts and baskets, payment, delivery, returns and guarantees. The basis is taking steps towards or performing a contract.
- Meeting our obligations: invoicing, accounting, taxes, consumer duties and requests from authorities. The basis is a legal obligation.
- Protecting and improving the service: security, fraud prevention, following up problems and monitoring customer service quality, including calls. We rely on legitimate interests, weighing your rights, or legal obligations where applicable.
- Optional analytics, advertising and marketing messages: measuring campaigns, attributing purchases and personalising ads. We use consent where required. Marketing messages are only sent with consent or another valid legal basis and include an unsubscribe option.
4. Where data comes from and what is required
Data comes from what you provide, your website use and providers involved in payment, delivery or support. Required fields enable us to handle your request or purchase; without them we may be unable to do so. Buying does not require you to accept analytics, advertising or marketing messages.
5. Who receives your data
Providers needed to deliver the service may access data necessary for their role: Stripe and your chosen payment method; NACEX and collection points; hosting, maintenance, security and communications; management systems such as Microsoft Dynamics 365 Business Central; customer support through Chatwoot and telephony through Zadarma; and accounting or professional advisers.
Google, Microsoft Clarity or Meta may be involved in measurement or advertising according to active features and your preferences, as explained in the Cookie Policy. We may also provide data to authorities, banks, insurers or courts where required or necessary to handle or defend claims.
Payment providers may apply their own automated fraud or eligibility checks and act as controllers for part of that processing. If a payment fails, we can help with your order status; the provider’s information explains its checks.
6. Processing outside the European Economic Area
Some technology or payment providers may process data outside the EEA. In those cases, safeguards required by data protection law must apply, such as an adequacy decision or standard contractual clauses, with additional measures where needed. You can ask us about the applicable safeguards.
7. How long we keep data
We keep data for as long as needed: account data while the account remains active, enquiries while handling and following them up, and orders or invoices for legal and liability periods. Technical and security logs have limited, proportionate retention periods.
Our telephony policy provides for 90 days for recordings, transcripts and summaries, and 365 days for call history, subject to necessary retention for obligations or claims. Where required, data is restricted and later deleted or anonymised when the periods end. Closing an account does not require us to delete invoices we must legally keep.
8. Your cookie and marketing choices
You can accept, reject or change optional categories through Cookie settings in the footer. The Cookie Policy explains the tools, limited technical cookieless signals used by certain providers and how to change your choice.
You can withdraw consent at any time and unsubscribe from marketing through the message itself or by contacting us. Withdrawal does not affect the lawfulness of earlier processing.
9. Your rights and how to exercise them
You can ask to access and obtain your data, correct it, erase it where appropriate, object to certain uses, restrict processing or receive it in a portable format where the conditions are met. You can also withdraw consent and request the safeguards applicable to solely automated decisions with legal or similarly significant effects.
Email info@motarea.com and tell us what you need. If identity verification is necessary, we will only ask for proportionate information. Exercising rights is generally free. We will respond within one month; if complexity or the number of requests requires up to two further months, we will tell you within the first month.
You can also complain to the Spanish Data Protection Agency (AEPD) or the competent data protection authority.
10. Security, minors and updates
We apply technical and organisational measures appropriate to the risk and limit access to those who need it, subject to confidentiality duties. The shop is not aimed at minors who cannot legally enter contracts themselves; if we discover data supplied without valid authorisation, we will act to address it.
We will review this policy when processing or legislation changes and display the update date. If you have questions, contact us and we will help explain how we use your data.
